REPUBLIC vs. DEMOCRACY

I pledge allegiance to the flag of the United States of America, and to the Republic for which it stands, one Nation under God, indivisible, with liberty and justice for all."
In the Pledge of Allegiance we all pledge allegiance to our Republic, not to a democracy. "Republic" is the proper description of our government, not "democracy." I invite you to join me in raising public awareness regarding that distinction.

The distinction between our Republic and a democracy is not an idle one. It has great legal significance.

The Constitution guarantees to every state a Republican form of government (Art. 4, Sec. 4). No state may join the United States unless it is a Republic. Our Republic is one dedicated to "liberty and justice for all." Minority individual rights are the priority. The people have natural rights instead of civil rights. The people are protected by the Bill of Rights from the majority. One vote in a jury can stop all of the majority from depriving any one of the people of his rights; this would not be so if the United States were a democracy. In a pure democracy 51 beats 49[%]. In a democracy there is no such thing as a significant minority: there are no minority rights except civil rights (privileges) granted by a condescending majority. Only five of the U.S. Constitution's first ten amendments apply to Citizens of the United States. Simply stated, a democracy is a dictatorship of the majority. Socrates was executed by a democracy: though he harmed no one, the majority found him intolerable.

SOME DICTIONARY DEFINITIONS

Government. ....the government is but an agency of the state, distinguished as it must be in accurate thought from its scheme and machinery of government. ....In a colloquial sense, the United States or its representatives, considered as the prosecutor in a criminal action; as in the phrase, "the government objects to the witness." [Black's Law Dictionary, Fifth Edition, p. 625]

Government; Republican government. One in which the powers of sovereignty are vested in the people and are exercised by the people, either directly, or through representatives chosen by the people, to whome those powers are specially delegated. Democracy. That form of government in which the sovereign power resides in and is exercised by the whole body of free citizens directly or indirectly through a system of representation, as distinguished from a monarchy, aristocracy, or oligarchy. Black's Law Dictionary, Fifth Edition, pp. 388-389.

COMMENTS

Notice that in a Democracy, the sovereignty is in the whole body of the free citizens. The sovereignty is not divided to smaller units such as individual citizens. To solve a problem, only the whole body politic is authorized to act. Also, being citizens, individuals have duties and obligations to the government. The government's only obligations to the citizens are those legislatively pre-defined for it by the whole body politic.

In a Republic, the sovereignty resides in the people themselves, whether one or many. In a Republic, one may act on his own or through his representatives as he chooses to solve a problem. Further, the people have no obligation to the government; instead, the government being hired by the people, is obliged to its owner, the people.

The people own the government agencies. The government agencies own the citizens. In the United States we have a three-tiered cast system consisting of people ---> government agencies ---> and citizens.

The people did "ordain and establish this Constitution," not for themselves, but "for the United States of America." In delegating powers to the government agencies the people gave up none of their own. (See Preamble of U.S. Constitution). This adoption of this concept is why the U.S. has been called the "Great Experiment in self government." The People govern themselves, while their agents (government agencies) perform tasks listed in the Preamble for the benefit of the People. The experiment is to answer the question, "Can self-governing people coexist and prevail over government agencies that have no authority over the People?"

The citizens of the United States are totally subject to the laws of the United States (See 14th Amendment of U.S. Constitution). NOTE: U.S. citizenship did not exist until July 28, 1868.

Actually, the United States is a mixture of the two systems of government (Republican under Common Law, and democratic under statutory law). The People enjoy their God-given natural rights in the Republic. In a democracy, the Citizens enjoy only government granted privileges (also known as civil rights).

There was a great political division between two major philosophers, Hobbes and Locke. Hobbes was on the side of government. He believed that sovereignty was vested in the state. Locke was on the side of the People. He believed that the fountain of sovereignty was the People of the state. Statists prefer Hobbes. Populists choose Locke. In California, the Government Code sides with Locke. Sections 11120 and 54950 both say, "The people of this State do not yield their sovereignty to the agencies which serve them." The preambles of the U.S. and California Constitutions also affirm the choice of Locke by the People.

It is my hope that the U.S. will always remain a Republic, because I value individual freedom.

Thomas Jefferson said that liberty and ignorance cannot coexist.* Will you help to preserve minority rights by fulfilling the promise in the Pledge of Allegiance to support the Republic? Will you help by raising public awareness of the difference between the Republic and a democracy?

I suppose if Athens had had the system of jurisprudence Vaxen describes, Socrates might have lived on...maybe with some admonition toward the old duffer. It all comes down to territory in my view. It soon will be dawn, and either a cardinal or Carolina wren will be first to announce where he is. At 6 I'll turn on the radio to sing With Heart And Voice. The announcements are merely to say Here is the area with which I shall mix my labor. I believe it best if the sound is friendly. My neighbors often announce their claim to territory with the startup of a mufferless old vehicle or even gunshots. Much of the friendliness of those sounds depends on my point of view. Do these announcements, by birds, beasts, or me, constitute "ownership?" Is this my property? What is property?

The word's root is in "propriety." A proprietor "owns" or manages a store or estate. But propriety is a much more vast concept. Propriety is the very nature of our being, the Way we interact. It is the fabric of community. Government is best based on propriety, not property---which is only one aspect...and a debateable one...of propriety. Can government tell me what to do on my property? Maybe. My neighbors drain their raw sewage into the creek that passes dangerously close to the water table feeding my well. There is almost no government in Waterloo Township. An adjoining town just dispensed with its police and streetlights. Its citizens prefer to keep their coins for private consumption. So be it. Yet, I worry that poor, outlaw township may covet what little we have over here. What then?

The word "proprietary" indicates that a party, or proprietor, exercises private ownership, control or use over an item of property, usually to the exclusion of other parties.

A party may have interests which are similar to proprietary interests in relation to certain types of information (e.g. for a creative literary work, or for computer software), which is the subject of certain laws, including copyright, patents or trademarks. This manner of speech is often used in reference to proprietary software.

Proprietary components are components that are unique to a specific manufacturer, and do not conform to preset standards.

-In Propria Personam (In Pro Per) means that the person is representing him or herself without an attorney.

-Pro Per: A term derived from the Latin in propria, meaning "for one's self," used in some states to describe a person who handles his/her own case without a lawyer.

Of course then there is 'propriatary.' But I shan't get into mincing words here. jazzo is a Democrat thus supports the almighty and all powerful state and its' Machiavellian machinations and even teaches them to his charges. What a world!

Also 'Pro Se' litigants are standing, alone (although oft with the service of counsel) representing ones' self. Propria-tary laws, then, are...? ;)

Unterseeboot 864

Unterseeboot 864 (U-864) was a German Type IX U-boat sunk on February 9, 1945 by the British submarine HMS Venturer, killing all 73 onboard. It is the first instance in the history of naval warfare that one submarine sank another while both were submerged. The shipwreck was located in March 2003 by the Norwegian Navy 2.2 miles west of the island of Fedje in the North Sea, at 150 metres.[1]

Career

Early career

Commanded throughout its entire career by Korvettenkapitän Ralf-Reimar Wolfram [2], it served with the 4th Submarine Flotilla (4 Unterseebootflottille) undergoing crew training from her commissioning until 31 October 1944. She was then reassigned to the 33rd Submarine Flotilla (33. Unterseebootflottille).[3]

Operation Caesar

The submarine was taking part in Operation Caesar, an attempt by Germany to prop up their flagging Japanese ally by providing them with advanced technology, and en route from Kiel to Japan with plans for the Messerschmitt Me 262 jet fighter,[4] jet engine parts, about 65 tons of metallic mercury and German and Japanese scientists and engineers.[5]

She set off through the Kiel Canal but grounded on the sea bed and had to make an unscheduled stop at the Bruno U-boat pens at Bergen. The crew left on shore leave, which lasted longer than expected after the pens and shipping in the harbour were attacked on 12 January by 32 Royal Air Force Lancaster bombers and one Mosquito bomber of Numbers 9 and 617 Squadrons. At least one of the tallboy bombs penetrated the roof of the bunker causing severe damage inside, and leaving one of the seven pens unusable for the rest of the war.[6] [7] Cryptographers at Bletchley Park had already learned of the plan.

British submarine HMS Venturer (commander, Lieutenant James "Jimmy" S. Launders, 25) was sent on her eleventh patrol from the British submarine-base at Lerwick in the Shetland Islands out to Fedje. After the U864 messages had been decrypted, she was rerouted to intercept the U-boat. The U-boat meanwhile had left Bergen, and of February 6th passed the Fedje area without being detected, but despite repairs at Bergen one of her engines began to misfire and she had to signal that she would again return to Bergen. A return signal stated that a new escort would be provided her at Hellisoy on 10th February. She made for there but on 9th February Venturer heard U-864's engine noise (Launders had decided not to use ASDIC since it would betray his position) and spotted the U-boat's periscope.

In an unusually long engagement for a submarine and in a situation for which neither crew had been trained, Launders waited 45 minutes after first contact before going to action stations, waiting in vain for U864 to surface and thus present an easier target. Upon realizing they were being followed by the British submarine and that their escort had still not arrived, U-864 zig-zagged in attempted evasive manoeuvres and each submarine risked raising her periscope. Venturer had only 4 torpedoes as opposed to U-864's 22, and so after 3 hours Launders decided to make a prediction of his opponent's zig-zag, and release a spread of his torpedoes into its predicted course. The first torpedo was released at 12.12 and then at 17 second intervals after that (taking 4 minutes to reach their target), and Launders then dived suddenly to evade any retaliation from his opponent. U864 heard the torpedoes coming and also dived deeper and turned away to avoid them, managing to avoid the first three but unknowingly steering into the path of the fourth. Exploding, she split in two, was sunk with all hands and came to rest more than 150m (500ft) below the surface on the seafloor.

The encounter between the U-864 and HMS Venturer was the subject of a Timewatch documentary on BBC Television broadcast on 5th January 2007. The programme switched between a reconstruction of the confrontation between the two submarines and a fly on the wall style documentary about a Norwegian vessel analysing the wreckage of the U-864.[8]

Rediscovery

There it lay until the Royal Norwegian Navy, alerted by local fishermen, found the wreck in early 2003. The mercury, contained in 1,857 rusting steel bottles located down in the vessel's keel, has started to leak and currently poses a severe environmental threat (see mercury poisoning and Minamata disease).

So far 4 kilograms per year of mercury is leaking out into the surrounding environment, resulting in high levels of contamination in cod, torsk and edible crab around the wreck.[9] Boating and fishing near the wreck has been prohibited. Although attempts using robotic vehicles to dig into the half-buried keel were abandoned after the unstable wreck shifted, one of the steel bottles was recovered. Its original 5 mm thick wall was found to have corroded badly, leaving in places only a 1 mm thickness of steel.[10]

The delicate condition of the 2,400-ton wreck, the rusting mercury bottles, and the live torpedoes on board would make a lifting operation extremely dangerous, with significant potential for an environmental catastrophe.[10][11] A three year study by the Norwegian Coastal Administration has recommended entombing the wreck in a 12 metre thickness of sand, with a reinforcing layer of gravel or concrete to prevent erosion. This is being proposed as a permanent solution to the problem, and the proposal notes that similar techniques have been successfully used around 30 times to contain mercury-contaminated sites over the past 20 years. [12]

I read French with understanding. Thanks A-d. Heh, heh...Agenda 21 is the UN's way of not dealing with real issues via real solutions (Soul-utions) and, as you mentioned elsewhere, it is really about 'control' of the worlds resources for the benefit of a few old families who deem themselves to be 'better' than everyone else.

Hitler, Bush, and even Enki and Nin Harsag, amongst the first geneticists to play around with gene splicing, fancy themselves rulers and owners of everyone and everything else on this planet. Guess they are all in for a very rude awakening...

Check out the Dutch and English Empires that came out of those two companies formed so early on and take a deep look at their methods of 'mind control.' Hell, Bayer brought heroin to this country and it was available over the counter to stop coughing! ;) Yeah...DOPE! Plenty of profit in ''controlled'' substances. Who and why...the control?
